The committee this day met, Hon. Frank D. Currier (chairman) presiding.

The Chairman. You. may proceed, Mr. Hayden.

Statement Of Mr. James H. Hayden, Attorney For The National Electric Signaling Company, Washington, D. C.

Mr. Hayden. Mr. Chairman and gentlemen, the company that I represent is the owner of a number of United States letters patent for improvements in wireless communication invented by Prof. R. A. Fessenden. It claims that its inventions have been used and are being used by the Government. The Government concedes that it is using them, but up to this time, the company has had no remedy by which it can secure from the Government reasonable compensation for the use of its patents. A bill identical with the one under consideration passed both Houses at the last Congress, but was not signed by the President and failed to become law. I can abbreviate my remarks by saying that the very thorough and able report made by Mr. Hinshaw in behalf of this committee at the last Congress presents our case. We could not improve on that statement.

The Chairman. Let me ask you a question. You were here one day with a suggestion that this bill be modified so that it should not apply to the continued use by the Government of any infringing device that the Government owned at the time of the passage of the act.

Mr. Hayden. As far as my client is concerned, that is true. We do not wish to appear before this committee in the light of ordinary claimants seeking compensation for something that has been done. We want a remedy for the future; but in saying that, I do not pretend to bind any other interest. This bill is a public measure. It was brought to the attention of the American Bar Association at Detroit last summer. A resolution endorsing it was adopted:

Resolved, That the report of the committee on patent, trade-mark, and copyright law on the subject of additional remedies for the protection of patented property, and the bill reported by the committee (bar association - patent, trade-mark, and copyright law) be approved by the association, and the committee be instructed to use their best efforts to secure the passage of the bill.
