The fact that the profession seems to have found the editor's New England edition of Stephen's Digest useful has suggested the idea of preparing the present work.

The Digest has for a generation had a distinctive position in England as the authoritative text on the subject, of evidence. From time to time American editions have appeared but they are all, with the exception of the New England edition, above referred to, based on the earlier English editions now superseded by that published three years ago. The effort is here made to present to the profession in this country the latest work of the English authors, thoroughly annotated with American cases. In the American note are collected authorities from all of the States, together with references to standard text-books. In recognition of the facts that the New York cases are very numerous and that the State of New York occupies a commanding position in jurisprudence, the authorities from that State have been placed by themselves and the citation of authorities from New York made as full as the limits of the book would allow.

The work is intended not as a rival of the three-volume books on Evidence, but as a handbook for the court and office.
